Terms & Conditions
BY REGISTERING FOR THE EVENT, PARTICIPANTS HAVE READ AND AGREED TO THE FOLLOWING TERMS AND CONDITIONS.
The following terminology applies to these Terms and Conditions:
As used herein, "Participant", "Registrant", “I”, “My” and "Mine" refers to the person who has registered and paid for the event, and accepted the Event's terms and conditions. "The Company", "Event Organiser", "Event Official", "Representative" and "Agent" refers to: (i) the organising company, ArGo Dance & Fitness, owners, employees, agents and representatives; (ii) Event employees and volunteers. The "Event" refers to Winter White West Coast Swing. The "Premises" refers to: (i) the associated venue; (ii) the owner of the premises and employees; (iii) affiliates and contractors of the owner of the premises, and their respective employees. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
1. RULES AND INSTRUCTIONS
I agree to observe and obey all posted rules and warnings, to follow any instructions or directions given by the Event Organiser through its Representatives and Agents. I also agree to abide by any decision of Event Officials relative to my ability to participate in or attend any or all of the sessions during the Event. If an Event Official judges me unfit to participate in a session, a valid reason will be supplied to me or I will be allowed to rejoin the session. I will accept any such decisions made by Event Officials and will not lay claim, financial or otherwise, to the Event Organiser in the future due to such decisions. I reserve the right to appeal such decisions to a senior Representative of The Company, but must do so immediately during the Event and in a pleasant and non-abusive manner. I will accept the decision of the senior Representative, regardless of the outcome.
2. EXPECTED BEHAVIOUR
I understand and agree that I am expected to exhibit appropriate behaviour at all times while at the Event or on the Premises, and to obey all local and regional, civil and criminal laws. This includes, generally, respect for other people, equipment, facilities or property. The Event Organiser may dismiss me, without refund, should my behaviour endanger the safety of or negatively affect the Event, Premises, or any person, facility or property. I also agree to indemnify the Event Organiser from any and all third party claims caused in whole or in part by my negligent or intentional acts or omissions.
3. BODILY INJURY AND PROPERTY DAMAGE
I am aware of potential hazards and risks of physical injury and/or property damage. I understand and agree that the Event Organiser shall not be liable for any and all bodily injury, property damage or other claims, regardless of severity, arising from or in connection with my participation in the Event, including claims that are known and unknown, foreseen and unforeseen, future or contingent.
I indemnify and hold harmless the Event Organisers from any loss, liability, damage or cost I may incur while I am at the Event or on the Premises, whether or not caused by the active or passive negligence of the Event Organisers. I agree if any claim for my personal injury or wrongful death is commenced against the Event Organiser, I shall defend, indemnify and save harmless the Event Organiser from any and all claims or causes of action by whomever or wherever made or presented for my personal injuries or property damage.
I agree to fully reimburse the Event Organiser and/or the Premises for any damage or cost I may incur during the Event, and shall not hold either the Event Organiser or the Premises responsible for such reimbursement.
4. CHANGES TO THE SCHEDULE OR INSTRUCTOR LINE-UP
I understand that the Event Organiser strives to organise the best possible Event and will, where possible, avoid drastic changes to the schedule or instructor line-up. In the event of unpreventable changes in the schedule or instructor line-up changes, the Event Organiser will post it as soon as possible on the Event webpage. If any such change cannot be announced online at least 24 hours before the commencement of the Event, notices will be placed at the Premises to notify Participants. By registering for the event and accepting these Terms and Conditions, I accept the unforeseeable nature of such circumstances and will not hold the Event Organiser responsible nor make claim, financial or otherwise.
5. PAYMENT POLICY
I, the Registrant, agree to pay within 3 days of registration or before the current pass price expires, whichever occurs first. I fully understand and accept the repercussions of untimely payment. The Company has the right to levy additional administrative fees or cancel my registration without refund, if I do not pay within the stipulated time.
6. CANCELLATION POLICY
I, the Registrant, may choose to cancel the registration. Cancelling the registration involves that I personally clearly notify The Company of such a cancellation. The date of cancellation is the date The Company receives my clear announcement of cancellation. I fully understand that there will be no refund of registration.
TRANSFERRING REGISTRATION
I may be allowed, upon approval by The Company, to transfer my registration to another dancer. Transferring rules are as follows:
REFUSAL FOR REFUND AND APPEALS
I acknowledge that the Company reserves the right to refuse a refund, but must supply me with a valid reason for the refusal. I agree to accept such refusal, or I must immediately appeal to The Company for reconsideration. For such appeals, I must supply a valid reason for the consideration of The Company. If I am unable to supply a reason within the time stipulated by The Company (3 days), I will have agreed to accept refusal of refund without reservation and will not in the future demand for a refund of this payment. By submitting an appeal, I agree to accept The Company's decision of the appeal, regardless of the outcome.
7. PHOTOGRAPHIC RELEASE
I grant and convey unto the Event Organiser irrevocable and unrestricted right and permission, to take, use, re-use, publish, and republish photographs, videos or voice recordings of me or in which I may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with my own or a fictitious name, or reproductions thereof in colour or otherwise, made through any medium, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other purpose whatsoeverin any and all photographic images and video or audio recordings made by the Event Organiser during the Event. I also consent to the use of any published matter in conjunction therewith. I agree to release to the Event Organiser all interest in the materials including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
8. PRIVACY POLICY
The Company understands the sensitive nature of the personal and credit information that I have supplied for the purposes of registration and payment for the Event. The Company promises not to make profit from the information by selling it to a third party. In these Terms and Conditions, I consent to The Company using my information for purposes as decided by The Company, including but not restricted to: record keeping, event notification and marketing campaigns organised by The Company. I am aware that it is my duty to inform The Company if I wish to unsubscribe from such mailing lists and will hold The Company blameless for future correspondence from The Company that I may view as unwanted.

TRANSFERRING REGISTRATION
I may be allowed, upon approval by The Company, to transfer my registration to another dancer. Transferring rules are as follows:
- If I am a leader, I can only find a leader to substitute.
- If I am a follower, I can find either a leader or a follower to substitute.
- Finding a substitute can only be done in an acceptable way in no abusing manner.
- The Company reserves the final right to refuse registration transfer in situations where abuse is suspected.
- An administrative fee will be charged for the transfer of registration, to be paid by either myself or the substitute.
REFUSAL FOR REFUND AND APPEALS
I acknowledge that the Company reserves the right to refuse a refund, but must supply me with a valid reason for the refusal. I agree to accept such refusal, or I must immediately appeal to The Company for reconsideration. For such appeals, I must supply a valid reason for the consideration of The Company. If I am unable to supply a reason within the time stipulated by The Company (3 days), I will have agreed to accept refusal of refund without reservation and will not in the future demand for a refund of this payment. By submitting an appeal, I agree to accept The Company's decision of the appeal, regardless of the outcome.
